SERVICE TERMS OF SERVICE

I. DEFINITIONS

Terms used in these Terms of Service have the meanings specified below:

  4. User – any person using the Service.

II. GENERAL PROVISIONS

  1. The purpose of these Terms of Service is to define the terms of providing services through the Service operated on the website https://www.tekaem.eu for the benefit of Users,
  2. The User may, under the terms of these Terms of Service, familiarize themselves with content made available in the Service and use the Service in such a way as to have access to it in a place and time of their choosing, regardless of the type and mode of operation of the device or application that the User uses for this purpose.
  3. A necessary condition for using the Service’s services is to consent to be bound by the terms resulting from the provisions of these Terms of Service. By using the Service, the User consents to the application of the provisions of the Terms of Service and to all changes introduced to it by Tekaem.
  4. The User confirms that they are of legal age and have full legal capacity, including in particular capacity in the scope of legal actions related to the use of the Service.
  5. Tekaem is not responsible for errors in published information, but makes every effort to ensure that information and images posted on the service are published in a manner enabling their correct display in the Service. Any display errors may result from incorrect settings of the User’s computer or failure to adapt the device configuration to software requirements.
  6. To the maximum extent permitted by law, Tekaem limits its liability to the User, does not and will not bear any liability for any damages or losses suffered by the User resulting from or in any way related – indirectly or directly – to the use of the Service, a transaction related to the use of the Service or disclosure of their data, subject to absolutely held statutory rights.
  7. Tekaem strives to ensure that the servers on which the Service is located are free from computer viruses and other malicious software, but is not liable for any damages caused by computer viruses and malicious software introduced there by third parties despite compliance with data processing security rules.

III. SERVICE CONTENT

  1. The content contained in the Service and its layout are protected under laws concerning copyright, industrial property rights (including in particular with regard to trademarks), databases and other sources of law concerning intellectual property and industrial property rights under national law and international treaties.   6. All applications, programs, layout and other content made available to the User while using the Service are the property of Tekaem or other entities related to Tekaem and it is prohibited to use them (or any part thereof) in any way other than using the made available version within the Service. Tekaem makes them available in the “as is” version and is not responsible for their correct operation.
  7. It is prohibited in any form or in any way (without limitation as to the duration of the prohibition):

The information does not constitute an offer within the meaning of the provisions of the Civil Code, even if marked with a price, but only an invitation to contact Tekaem. Prices of Goods are specified in price lists made available by Tekaem, as well as at its registered office and branches, and are valid for the period indicated in the given price list. In the case of orders whose execution is related to special processing or cutting of a product, the price of the product is finally determined for a specific offer, whereby if this price is different from the price list, the buyer should separately accept such changed price.

IV. LIMITATIONS OF TEKAEM’S LIABILITY

  1. Tekaem makes the Service and all applications connected with it available in the “as is” form and does not guarantee their correct operation, and the User uses the Service at their own risk and bears full responsibility for any damages (including losses or lost profits) resulting from downloading information in the Service and relying on information contained in the Service. Tekaem is liable only to the extent that provisions of universally and absolutely binding law do not allow exclusion of its liability).
  2. Tekaem is not liable for consequences resulting from the use of the Service’s content in an improper manner. Tekaem is not liable for indirect, secondary damages, economic losses and lost profits related to the use of the Service’s content and its operation.
  3.   4. Tekaem does not give any assurances, guarantees or commitments that the Service, or the server on which it is available, are free from defects, including but not limited to viruses or other harmful elements.

V. COOKIES

  1. Tekaem uses Cookies in the Service, i.e., small text information stored on the end device, i.e., the User’s computer, phone, tablet.
  2. Tekaem may collect data regarding the User’s visit such as: IP address, browser type, operating system, etc.

VI. COMPLAINT PROCEDURE

  1. Every User has the right to file a complaint in matters related to the operation of the Service.

  3. The Service Provider will consider the complaint immediately, but no later than within 14 days from the date of its receipt.
  4. The response to the complaint will be sent to the User to the address provided by the User in the complaint.
  5. The Service Provider reserves the right to extend the deadline specified in point 3 above – by no more than 10 days – in case consideration of the complaint requires unusual, special actions and arrangements or encounters obstacles independent and not caused by the Service Provider (equipment failures, internet network, etc.). The Service Provider further reserves that consideration of the complaint may require obtaining additional explanations from the User, whereby in such case the time for providing explanations by the User will each time extend the period for complaint consideration.

VII. FINAL PROVISIONS
