Product Return Policy
The Consumer has the right to withdraw from the Sales Agreement within 14 days without providing any reason.
The period referred to above begins on the day the Product is delivered to the Consumer or to a person indicated by the Consumer other than the carrier.
In the case of an Agreement covering several Products delivered separately, in batches or in parts, the period begins on the day of delivery of the last item, batch, or part.
The Consumer may withdraw from the Agreement by submitting a declaration of withdrawal to the Seller. To meet the withdrawal deadline, it is sufficient for the Consumer to send the declaration before the period expires.
The declaration may be sent by traditional mail, fax, or electronically by sending it to the Seller’s e-mail address or by submitting it through the Seller’s website. The Seller’s contact details are specified in §3.
The declaration may also be made using the form template attached as Appendix No. 1 to these Terms and Conditions and as an annex to the Act of 30 May 2014 on Consumer Rights; however, use of the form is not mandatory.
If the Consumer submits the declaration electronically, the Seller shall promptly send a confirmation of receipt of the declaration of withdrawal to the e-mail address provided by the Consumer.
Effects of Withdrawal from the Agreement
If the Consumer withdraws from a distance contract, the contract is deemed not to have been concluded.
Upon withdrawal, the Seller shall promptly – and no later than 14 days from the day the Consumer’s declaration of withdrawal is received – refund all payments made by the Consumer, including delivery costs, except for additional costs resulting from the Consumer’s choice of a delivery method other than the cheapest standard delivery method offered by the Seller.
The refund shall be made using the same payment method that the Consumer used in the original transaction, unless the Consumer expressly agrees to another method that does not entail any additional costs.
The Seller may withhold the refund until the Product has been received back or until the Consumer provides proof of its return, whichever occurs first.
The Consumer must return the Product to the Seller’s address indicated in these Terms and Conditions without undue delay, and no later than 14 days after notifying the Seller of the withdrawal. The deadline is met if the Product is sent before the expiry of the 14-day period.
The Consumer shall bear the direct costs of returning the Product, including cases where, due to its nature, the Product cannot be returned by ordinary postal means.
The Consumer is liable only for any reduction in the value of the Product resulting from its handling in a way other than what was necessary to establish its nature, characteristics, and functioning.
If, due to the nature of the Product, it cannot be returned by ordinary mail, information about this and about the cost of return will be included in the Product description in the Store.
The Right of Withdrawal Does Not Apply to Distance Contracts:
- in which the item is non-prefabricated, made to the Consumer’s specifications or clearly personalized to meet their individual needs,
- in which the item is delivered in sealed packaging that cannot be returned after opening for health protection or hygiene reasons, if the packaging was opened after delivery,
- in which the item is perishable or has a short shelf life,
- for the provision of services, if the Seller has performed the service in full with the Consumer’s express consent and after the Consumer was informed that they would lose the right of withdrawal once the service was performed,
- in which the price or remuneration depends on fluctuations in the financial market beyond the Seller’s control, which may occur before the withdrawal deadline,
- in which the items, by their nature, become inseparably connected with other goods after delivery,
- in which the goods are alcoholic beverages, the price of which was agreed upon at the time of concluding the sales contract, and delivery may take place only after 30 days, and whose value depends on market fluctuations beyond the Seller’s control,
- in which the subject of the contract is audio or video recordings or computer software delivered in sealed packaging, if the packaging was opened after delivery,
- for the supply of newspapers, periodicals, or magazines, except for subscription contracts,
- for the supply of digital content not recorded on a tangible medium, if performance began with the Consumer’s express consent before the withdrawal period expired and after the Consumer was informed about the loss of the right of withdrawal.
